Anti-dumping Duty on Alloy Steel from China, Korea and Thailand – Final Findings

G.S.R.--(E). -Whereas, the designated authority, vide notification number 7/12/2021- DGTR, dated the 1st September, 2021, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 1st September, 2021 had initiated a mid-term review in accordance with section 9A of the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act) read with rule 23(1A) of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the said rules), in the matter of anti-dumping duty on imports of “Cast Aluminum Alloy Wheels or Alloy Road Wheels (ARW) used in motor vehicles, whether or not attached with their accessories, of a size in diameters ranging from 12 inches to 24 inches”, falling under the sub-heading 8708 70 of the First Schedule to the Customs Tariff Act, originating in, or exported from China PR, Korea RP and Thailand, imposed vide notification of the Government of India, Ministry of Finance (Department of Revenue) No. 17/2019-Customs(ADD), dated the 9th April, 2019, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 296(E), dated the 9th April, 2019;

And whereas, the designated authority, in its final findings in the mid-term review vide notification No. 7/12/2021-DGTR, dated the 30th August, 2022, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 30th August, 2022, has recommended that there is a need for modification of the quantum of duty imposed on the imports of “Cast Aluminum Alloy Wheels or Alloy Road Wheels (ARW) used in motor vehicles, whether or not attached with their accessories, of a size in diameters ranging fro m 12 inches to 24 inches” originating or exported from China PR, imposed vide notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 17/2019-Customs(ADD), dated the 9th April, 2019, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 296(E), dated the 9th April, 2019;

Now, therefore, in exercise of the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act, read with rules 18, 20 and 23 of the said rules, the Central Government hereby makes the following amendments in the notification of the Government of India, in the Ministry of Finance (Department of Revenue), No. 17/2019-Customs (ADD), dated the 9th April, 2019, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i) vide number G.S.R. 296(E), dated the 9th April, 2019, namely:-

In the said notification,

i. for the portion beginning with the words “after considering the aforesaid final findings of the designated authority” and ending with the words “per unit of measurement specified in the corresponding entry in column (8) of the said Table”, the following shall be substituted, namely: -

“after considering the aforesaid final findings and the final findings issued vide F.No. 7/12/2021-DGTR, dated the 30th August, 2022 of the designated authority, hereby imposes on the subject goods, the description of which is specified in column (3) of the Table below, falling under sub-heading or tariff item of the First Schedule to the Customs Tariff Act as specified in the corresponding entry in column (2), originating from the countries as specified in the corresponding entry in column (4), exported from the countries as specified in the corresponding entry in column (5), and produced by the producers as specified in the corresponding entry in column (6), an anti-dumping duty at the rate equal to the amount as specified in the corresponding entry in column (7), in the currency and per unit of measurement specified in the corresponding entry in column (8) of the said Table.” ;

ii. for the Table, the following Table shall be substituted, namely: -
