Minutes of the 12th Inter-Ministerial Committee meeting for recognition and review of Pre-Shipment Inspection Agency under Appendix 5 of HBP (Vol.I)

The Chairman welcomed the members of the Committee. The representatives of AERB and MoEF did not attend the meeting. However, the comments were received from AERB by e-mail dated 10/1/2014 and the Committee decided to proceed by taking into consideration the comments received from AERB by mail.

Part I –Recognition as PSIA

The Committee, in the IMC meeting held on 3/9/2013, had decided that last chance may be given to the applicant to submit the technical details. The applicant has submitted details of Radiation Survey Meter & Portable Spectrometer.

The applicant had applied for recognition for:

(i) USA

(ii) Iran

AERB has informed vide e-mail dated 10/1/2014 that while the Portable Spectrometer is OK, the response time of the Survey Meter is very high and is not acceptable.

Decision of the IMC

The Committee decided to inform the applicant about the deficiencies raised by AERB. The request of M/s American Quality Assessors (India) Pvt. Ltd., Hyderabad for recognition as PSIA was deferred.

M/s Geo-Chem Inspection (Malaysia) SDN BHD, Malaysia

The applicant had applied for recognition for Russia, Pakistan, Korea, European Union, Brazil, Argentina and Ukraine. They have now curtailed their request to Malaysia. They had purchased the equipment from M/s Geo-Chem Far East Pte. Ltd., Singapore who had been de-listed.  TheCommittee, in the IMC meeting held on 3/9/2013 decided that the above equipment cannot be allowed for conducting an inspection of pre-shipment. The applicant has now purchased new equipment.

AERB vide e-mail dated 10/1/2014 has informed that both Survey Meter and Portable Spectrometer are OK.

The application was found to be in order and AERB had found that both Survey Meter and Portable Spectrometer are OK. The Committee decided to recognise M/s Geo-Chem Inspection (Malaysia) SDN BHD, Malaysia as PSIA for Malaysia.

The case was deferred in the IMC meeting held on 10/7/2013 as the energy range of the Hand-held Survey Meter was not within the requisite range. The case was also deferred in the IMC meeting held on 3/9/2013 for want of above clarifications and as they did not have office in Sri Lanka & Bangladesh, for which they had sought recognition.

AERB has informed vide e-mail dated 10/1/2014 that while the Portable Spectrometer is OK, the response time of Survey Meter is very high, not acceptable and the useable energy range should start from 60 keV.

The Committee decided to inform the applicant about the deficiencies raised by AERB. The request of M/s A Bureau Veritas (India) Pvt. Ltd., Mumbai for recognition as PSIA was deferred.

The applicant was approved as PSIA for UAE in the IMC meeting held on 10/7/2013 subject to address verification. An e-mail was sent to the Consulate General of India at Dubai. A reply dated 6/1/2014 has been received stating that they had visited their office and nothing adverse has come to the notice of the Consulate.

Decision of the IMC

In view of confirmation of address as well as report from Indian Consulate at Dubai that nothing adverse has come to their notice, the Committee decided to recognise M/s Global Mines and Minerals FZE, UAE as PSIA for UAE.

The Committee decided to inform the applicant about the deficiencies raised by AERB. The request of M/s Qtech Control Ltd., UK for recognition as PSIA was deferred.

The case was considered in the IMC meeting held on 3/9/2013 and the applicant was approved as PSIA for one country as they had 2 Hand-held Survey Meters and 1 Portable Spectrometer. They were required to indicate the specific country because they had applied for 38 countries. The applicant vide e-mail dated 23/9/2013 has requested to be recognised as PSIA for India. DGFT is not recognising any PSIA for India at present (as decided in the case of M/s Gattini & Co., Mumbai). The applicant has requested vide e-mail dated 8/11/2013 to be recognised as PSIA for Singapore & Malaysia.

Since, the applicant has one Portable Spectrometer and has given the complete address for Singapore only, the Committee decided to recognise M/s Cotecna Inspection India Pvt. Ltd., Mumbai as PSIA for Singapore.

The Committee decided to ask the applicant to inform in which EU countries they have a presence and for which countries they want to be recognised as PSIA.

AERB vide e-mail dated 10/1/2014 has informed that while the Survey Meter is OK; for Portable Spectrometer, the column ‘Provision of self calibration’ should be ‘Yes’. Clarification may be sought from the party.

The Committee decided to inform the applicant about the deficiencies raised by AERB. The request of M/s Ravi Energie INC, USA for recognition as PSIA was deferred.

The applicant has been recognised as PSIA for UAE vide Public Notice No. 34 dated 29/10/2013. Vide e-mail dated 30/10/2013, they have requested to indicate their head office at Mumbai in the Public Notice.

The Committee decided that as requested by Ms Gattini & Co., Mumbai, their Mumbai head office address may be shown in the Public Notice.

It was brought to the notice of the Committee that the IMC in its meeting held on 12.4.2013 had decided that addition of new territories shall not be allowed in future and if a PSIA wishes to enlist new territory, they may file a new application in Appendix 5 along with prescribed documents and application fee. The applicant has not submitted the requisite application fee and Appendix 5.

AERB vide e-mail dated 10/1/2014 has informed that both Survey Meter and Portable Spectrometer are OK.

Decision of the IMC

The Committee decided to defer the case for want of application in Appendix 5 along with application fee.

The Committee decided to recognise M/s Headway Inspection Services Ltd., Dubai as PSIA for 6 territories i.e. (i) Australia, (ii) Lebanon, (iii) Saudi Arabia, (iv) Jordon, (v) Bahrain & (vi) Angola.  For the request of PSIA to be nominated for Central America & Caribbean Islands, it was decided that they may indicate specific country.

Ltd., Mumbai in the AERB format, however, it has now been confirmed that the mistake was committed by M/s Tubby Impex Pvt. Ltd.

The application was found to be in order and AERB had found that both Survey Meter and Portable Spectrometer are OK. The Committee decided to recognise M/s Asia Inspection Agency Company Ltd., Thailand as PSIA for (i) Thailand/Vietnam as one territory, (ii) Saudi Arabia and (iii) Angola.

The serial numbers of Survey Meters were the same as mentioned by M/s Asia Inspection Agency Company Ltd., Thailand in the AERB format. However, it has now been confirmed that the wrong serial numbers were mentioned by mistake by M/s Tubby Impex Pvt. Ltd and they have sent a revised AERB format with correct serial numbers.

Decision of the IMC

The application was found to be in order and AERB had found that both Survey Meter and Portable Spectrometer are OK. The Committee decided to recognise M/s Tubby Impex Pvt. Ltd., Mumbai as PSIA for (i) South America with head office at Brazil, (ii) Russia and (iii) Namibia.

The applicant was recognised as PSIA for 9 countries/regions vide P.N. No. 52 dated 28/3/2013 for a period of 6 months as an investigation was being conducted by the Customs. Their recognition has ended on 30/9/2013. A report has been sought from Customs, Kandla.

Decision of the IMC

The IMC noted that a complaint was received against the applicant and a report was sought from Kandla, Custom.  Therefore, the IMC decided that the matter may be considered on receipt of report from Commissioner of Customs, Kandla. Their recognition may not be extended beyond 30/9/2013 till receipt of report from Customs, Kandla.

Part II –Location of PSIA not found, show cause notice isued

The applicant was approved as PSIA for 13 countries vide P.N. No. 27 dated 19/10/2013. During verification of their address at Sierra Leon, one of the country for which they had been recognised, it was found that they were not physically present at the given address. A show cause notice was issued to the firm on 12/7/2013 and the issue is under consideration.

Decision of the IMC

The IMC noted that a Show Cause notice has been issued to the firm since their address could not be confirmed by Consulate of India at Sierra Leon.  As such the case was deferred.

The applicants were asked to submit invoices in support of the equipment held by them. They have informed that they have replaced / destroyed their original equipment and purchased new equipment.

Decision of the IMC

The IMC noted that the applicants have not given any documents in respect of their earlier equipment, which they have claimed to have been replaced / destroyed. The Committee decided that documents in support of their contention may be called for.
