Simplification of WPC Import License Requirements
for Domestic Original Telecom Equipment Manufacturers to enable India as Manufacturing

This is with
reference to The National Digital Communications Policy, 2018 which seeks to
unlock the transformative power of digital communications networks- to achieve
the goal of digital empowerment and improved well-being of the people of India;
and towards this end, attempts to Catalysing Investments
for Digital Communications sector (by Simplifying) and facilitating Compliance Obligations
under Simplifying import licensing requirements of Wireless Planning and
Coordination (WPC) Wing, it has been decided to implement the following
guidelines for Importing Transceivers / Radio
Modules by Domestic Original Telecom Equipment Manufacturers to enable India as
manufacturing Hub.
(i)
As part of "ease of doing business". Domestic Original Telecom
Equipment Manufacturers in Domestic Tariff Area (DTA) are
allowed to import Transceivers / Radio
Modules against their valid Dealer Possession License without any need for
Import license and quantities as per requirement. They are permitted to supply
these manufactured wireless equipments to domestic
customers against a confirmed Purchase Order and Supplier Proforma
Invoice and also to export these manufactured wireless
equipments. At the time of import, Domestic Original
Telecom Equipment Manufacturers shall submit an undertaking as per Annexure to
Custom authorities and RLO (alongwith technical literature
specifications to RLO) as applicable with respect to the port of Import.
(ii) Such sales to
domestic customers in Domestic Tariff Area (DTA) would be
done provided they have valid Frequency authorisation
from WPC Wing of DoT as approved by the regulatory body. Further. Domestic Original Telecom Equipment Manufacturers would provide the
regular update on import and distribution data as per the stipulation of DPL to
give the regulator the control of what has been imported and how it was
delivered, while the Operator I customers
would be responsible to take care of their obligations under UASL or equivalent
licenses with valid Frequency authorisation from WPC
of DoT as approved by the regulatory body.

Further, I hereby
undertake that:
(i)
not to sell any Wireless Telecom equipment to any
Telecom Service Provider without purchase order, Supplier Proforma
Invoice who does not hold valid Frequency authorisation
from WPC Wing of DoT as approved by the regulatory body.
(II) to maintain stock register in the Form III.IV & V as
prescribed in the Indian Wireless Telegraphy (Possession) Rules, 1965, upon
every transaction (either import-export and/or sale).
(III)
to provide stock details as on date in Form Ill, after
import of every consignment.
(IV) that, if any unauthorised sale is
found by licensing authorities, I shall pay a penal amount equivalent to
spectrum charges from date of invoice alongwith
applicable late fee as applicable. Apart from it, any penal action as per ITA
1885/IWTA 1933 including cancellation of DPL may also take against me, by the
licensing authorities.
