Marking Must on Package Even in a E-labelling Cases

Subject: Marking requirement as per self-declaration of Conformity {Scheme-II of Schedule II of BIS (Conformity Assessment) Regulations, 2018}

1. BIS (Conformity Assessment) Regulations, 2018 have been notified and labelling and marking requirements are covered under para 6 of Scheme II of Schedule II of the regulations. BIS license holders under Scheme II are required to ensure compliance to these requirements.

2. The provision of e-labelling also exists for which guidelines as per circular CMD-III/9:6/e-labelling dated 13.09.2017 have been issued.

3. In regard to marking of reference to BIS website, as per provision of para 6 (7) of Scheme II, the following is clarified:

i)   BIS website reference www.bis.gov.in is to be marked on the product or package or both.

ii)  The marking is required even if the reference to BIS website is provided in e-labelling of the product.

iii)  Registered product meant to be integrated or built into the host product need to comply with the requirement of marking of reference to BIS website until integrated with the host product.

4. This circular supersedes all previous circulars other than above mentioned circular on e-labelling.

Subject: Marking requirement as per self-declaration of Conformity {Scheme-II of Schedule II of BIS (Conformity Assessment) Regulations, 2018}

1. This has reference to letter dated 08.08.2019 (C-95) from ICEA, raising issues including that with respect to marking (product specific for cell/batteries), and some general issues.

2. Note has been sent to ETD and CMD-III regarding marking requirements for Cells/Batteries (product specific requirements) (C-112 & C-113 respectively) based on inputs/comments received from ICEA, MAIT & JEITA (C-94, 95; 96, 97 & 101,102).

3. Industry Associations had earlier sought guideline on the marking of BIS website reference (C-63) and a circular Ref: Registration/CRS (E & IT) Goods dated 31.08.2018 (C- 67) was issued.

4. In view of the request of ICEA seeking withdrawal of BIS circular requiring marking of BIS website reference vide their email dated 19.11.2019 while citing the impending implementation of Mandatory Test and Certification of Telecom Equipment (MTCTE) Scheme by Ministry of Telecom which would require further requirements for marking, a meeting was held on 03.12.2018 with Industry Associations and clarification was issued to them (C- 82-83). It was decided to review the status in Feb 2019 since MTCTE was to be implemented in April 2019.

5. Industry Association have now brought to notice that MTCTE Order implementation is further deferred and have requested that a formal circular elaborating the marking of BIS website reference be issued in continuation with the decision taken on 03.12.2019. (C-98 & 99).

6. Marking requirements have been notified in BIS (Conformity Assessment) Regulations, 2018 at Para 6(7) of Scheme-II of Schedule-II and requirements of earlier circulars in this regard are covered in the Regulations except for the guidelines on e-labelling issued by CMD-III vide their reference CMD III/9:6/e-labelling dated 13.09.2017.(C-114)

7. In view of the request received as mentioned at (5) above, and with a view to consolidate the marking requirements, it is proposed to issue a circular drawing attention to the BIS (Conformity Assessment) Regulations, 2018 and the supersession of earlier circulars issued by BIS with regard to marking (except for guidelines on e- labeling issued by CMD-III), while elaborating on the marking of reference to BIS website.
