DGFT Seeks Stakeholder Comments on Aligning Export Policy (ITC HS 2022) with Finance Act, 2026 Amendments

·         The Directorate General of Foreign Trade (DGFT) has initiated the process of aligning Schedule-II (Export Policy) of ITC (HS), 2022 with changes introduced through the Finance Act, 2026.

·         The Finance Act, 2026 has made several amendments to the First Schedule of the Customs Tariff Act, 1975, including:

o    Changes in HS Codes.

o    Revisions to Product Descriptions.

o    Amendments to Chapter Notes.

·         In accordance with Para 1.07A of the Foreign Trade Policy (FTP) 2023, DGFT is undertaking stakeholder consultations before making amendments to the export policy schedule.

·         DGFT has circulated:

o    Annexure-I containing proposed changes in Chapter Notes.

o    Annexure-II containing proposed changes in HS Codes and Product Descriptions.

·         Comments and suggestions are invited from:

o    Exporters.

o    Industry associations.

o    Trade bodies.

o    Subject matter experts and other stakeholders.

·         Stakeholders are required to submit their views/comments within 7 days from the date of issuance of the Trade Notice.

·         Feedback may be submitted via email to export-dgft@nic.in.

·         The Trade Notice has been issued with the approval of the Competent Authority under the provisions of Para 1.07A of FTP 2023.

Key Implication

·         The proposed alignment will ensure that India's Export Policy Schedule (ITC HS 2022) remains consistent with the latest tariff classification changes introduced under the Finance Act, 2026, facilitating uniformity in export regulation and customs classification.

Subject: Request for comments on alignment of Schedule-II (Export Policy) of ITC (HS), 2022 consequent to amendments introduced under the Finance Act, 2026.

Reference is drawn to Finance Act, 2026 which has introduced several changes to the First Schedule of the Customs Tariff Act, 1975, including amendments in HS Codes, Product Descriptions, and Chapter Notes. In light of these changes, the Directorate General of Foreign Trade (DGFT) is in the process of aligning Schedule-II (Export Policy) of ITC (HS) 2022 accordingly.

2. In line with Para 1.07A of FTP 2023, which provides for consultation with stakeholders during the formulation or amendment of Foreign Trade Policy, proposed changes in Chapter Notes as introduced in the Finance Act, 2026 (Annexure-1) and changes in HS Codes and Product Descriptions (Annexure-11) are enclosed to this Trade Notice.

3. This Directorate invites views, suggestions and comments from relevant stakeholders including exporters, industry associations and experts on the proposed amendments. The stakeholders are requested to submit inputs/ comments to this Directorate within 7 days from the issuance of this Trade Notice. Submissions may be made via e-mailto export-dgft@nic.in.

4. This Trade Notice is issued with the approval of the Competent Authority in accordance with the provisions of Para 1.07A of FTP 2023.
