Clarifications on Input Service Distributor (ISD) Mechanism
[GST Circular No. 260/06/2026-GST dated
October 26, 2026]
The Central Board of Indirect Taxes &
Customs (CBIC) has issued Circular No. 260/06/2026-GST dated October 26,
2026. This circular provides critical procedural clarifications under Section
20 of the CGST Act regarding the operation, distribution timelines, tax
compliance responsibilities, and refund calculations for Input Service
Distributors (ISD).
Key Highlights &
Clarifications
·
Multiple ISD Registrations Permitted: There is
no legal restriction under the GST framework preventing a company from
obtaining more than one ISD registration for separate business verticals
or distinct places of business within a single State or Union Territory.
·
Compliance Liabilities Shared:
o
The ISD office is responsible for
distributing the credit proportionally to the specific distinct locations to
which the input service is actually attributable. If the ISD distributes excess
credit irregularly, it faces statutory penalties.
o
The end-recipient units are responsible for
fulfilling eligibility conditions under Sections 16 and 17, including executing
any required credit reversals.
·
Defining the Distribution Month: Under
Rule 39(1)(a), credit must be distributed in the same month it becomes
"available". The CBIC clarifies that credit is considered available only
when the ISD office ascertains that it is prima facie eligible for availment, and it must be distributed in the month this
internal verification takes place.
·
Rule 54(1A) Invoices Excluded from Turnover: Regular
registrations transferring credit (like tax paid under the Reverse Charge
Mechanism) to an ISD office via Rule 54(1A) are using a purely operational
credit-transfer mechanism. Consequently:
o
These transfer amounts do not qualify as
"turnover in a State/UT" for the transferring unit.
o
These funds cannot be counted as "Net
ITC" to claim maximum export refund calculations under Rule 89.
o
The transferring unit is exempt from making ITC
reversals under Section 17 on these amounts; the reversal liability remains
solely with the ultimate recipient units.
