Procedure for
Obtaining Export Licence for Export of Red Sanders Wood Sourced from Private
Land

Effect of this Public Notice: Procedure to obtain
export license from DGFT for export of Red Sanders wood in log form, roots and
value added products exclusively sourced from cultivation origin obtained from
private land (including Pattaland) under Chapter 44 of ITC(HS} Classification
of Export and Import Items 2018 has been prescribed.
Subject:- Export Policy of Red Sanders wood exclusively
sourced from cultivation origin obtained from private land (including
Pattaland) - Procedure to obtain export license.
In exercise of the powers conferred under Paragraph 1.03
of the Foreign Trade Policy(FTP) 2015-20, the Director General of Foreign Trade
(DGFT) hereby specifies the conditions and procedures, as under, to be followed
by the exporters, for obtaining export license for export of Red Sanders wood in
log form, roots and value added products exclusively sourced from cultivation
origin obtained from private land (including Pattaland), as specified under
Chapter 44 of ITC(HS) Classification of Export and Import, in Items 2018 in
terms of revised export policy notified vide

2. The terms & conditions and procedure for obtaining
export license from DGFT for export of Red Sanders wood exclusively sourced
from cultivation origin obtained from private land (including Pattaland) shall
be as follows:
(a) As per the recommendation of CITES Management Authority India, the Ministry
of Environment, Forests and Climate Change (MOEF&CC) has recommended an
yearly quota of 310 MT (250 MT for Andhra Pradesh and 60 MT for Tamil Nadu),
for export of Red Sanders wood exclusively sourced from cultivation origin
obtained from private land (including Pattaland);
(b) The yearly quota is effective from the year 2017-18;
(c) The yearly quota may be reviewed by the MOEF&CC based on NDF
study or recommendations of the Government agencies;
(d) As the quota fixed for year 2017-18 could not be exported during
that year in absence of the export policy, total 620 MT quantity shall be available
for 2018-19 (till 31.03.2019);
(e) Prospective exporters shall submit their application seeking export
license from the DGFT (Hqrs) through email at: export-dgft@nic.in in terms of Trade Notice No. 35 dated 25.10.2018 available
on the website of DGFT under heading captioned 'Polices';
(f) Each application shall be forwarded to MOEF&CC (SU Division) through
email for their 'No Objection Certificate' (NOC) I comments and thereafter placed
before the Exim Facilitation Committee (EFC) in DGFT for its consideration;
(g) For the year 2018-19, duly filled in application (in prescribed
proforma with requisite documents) shall be considered in DGFT on the basis of
NOC granted by MOEF&CC and quantity shall be allocated by the EFC as per
the criteria laid down by it;
(h) The application for seeking export license shall be accompanied
with the following documents:-
For export of red
sanders in log form and roots:-
(i) Application in ANF-2N (form for export license for restricted
items);
(ii) ANF-1(Profile of Exporter & Importer)
(iii) A self certified copy of IEC (Importer Exporter
Code)
(iv) Export Order received by the concerned firm.
(v) Details of procurement of item i.e. quantities, legal source etc.
(vi) A certificate of the current position of stocks so procured and
available with the applicant given after physical verification of the stocks,by
the authority nominated for the purpose by the PCCF;
(vii) Attested copies of Certificate of Origin (COO) issued by the
concerned PCCF (in prescribed proforma) (Trade Notice No. 35 dated 25.10.2018);
(viii) Log list of the items issued by the PCCF of the
concerned State for proposed exports
For export of value
added products of red sanders:-
(i) Same documents as specified at Sl. No. (i) to (vii) above;
(ii) Physical Verification Report by the concerned officer designated by
the Forest Department/PCCF;
(iii) List of items, number,sizes and coloured photographs of the value
added products of red sanders duly certified by the concerned officer designated
by the Forest Department/PCCF;
(iv) An undertaking from the firm stating that the items proposed for
export are in terms of sizes and specification specified under Sl. No. 189, Chapter
44,Schedule 2.
For obtaining COO from
PCCF & HOFF of source I other State for export of red sanders wood
(i) The applicant/ exporter would require to submit application in
prescribed proforma [in terms of proforma specified in DGFT Trade Notice No. 35
dated 25.10.2018 available on the website (www.dgft.gov.in)] before Principal
Chief Conservator of Forests (PCCF) & Head of Forest Force (HOFF) of the
source I exporting State, as applicable for issue of Certificate of Origin
(COO);
(ii) In case the item is proposed to be exported from a State other
than the source State (Andhra Pradesh or Tamil Nadu), requisite permission of
the Forest Department of the source State, Transit pass etc. for transfer of
the item (s) to other states, to be attached along with the application to be
made with the PCCF;
(iii) In such cases, the PCCF of the 'other' State shall issue the COO
after duly verifying the origin of the material on the basis of documents such
as legal source of the item, permission I transit pass for transfer of the item
from 'source' state, current position of stocks available with the applicant as
verified by the authority nominated for the purpose by the PCCF;
(iv) The PCCF of the 'source' state or the 'other' state, as applicable
shall issue COO in prescribed proforma circulated by the MOEF&CC along with
log list of the items, in case logs or roots are exported [a copy of the
proforma is available in DGFT Trade Notice No. 35 dated 25.10.2018].
3. Applications received from the exporters would be
considered by the DGFT(Hqrs) in consultation with the MOEF&CC for their
NoC/ comments, subject to fulfilment of all conditions along with all requisite
documents, as prescribed at para 2 above (as may be amended from time to time
by the DGFT in consultation with MOEF&CC).
4. The applications shall be considered on merits. The
following criteria will be followed for the purpose:
(i) Duly filled in application (in prescribed proforma along with the
requisite documents) are to be sent through email at export-dgft@nic.in in PDF format in terms of DGFT Trade Notice No.
18/2015-20 dated 20.06.2018 (https://bit.ly/2R40d j0);
(ii) The date and time of filing of applications through email at export-dgft@nic.in would be the criteria for considering the merit;
(iii) The applications, seeking restricted export license of the subject
item, received through post I courier or any other mode in DGFT (Hqrs) will not
be entertained;
(iv) The applications, which are received without proper I complete
documents, the priority shall be counted from the date of submission of
complete documents in PDF format at designated email.
5. The status of applications of all 'Restricted' items
will be updated time to time on the DGFT website (www.dgft.gov.in) under
heading captioned 'Exporter Facilitation' - Restricted Licenses Application
Status- Non-SCOMET Export License.
