China Origin ADD Revival on Sodium Nitrite Sought on Complaint of Deepak Nitrite with the Support of Kutch Chemical Industries

Initiation of Anti-Dumping Investigation

·         The Directorate General of Trade Remedies has officially initiated an investigation into alleged dumping of Sodium Nitrite from China PR.

·         The investigation aims to determine if dumped imports are causing material injury to the domestic industry.

·         The case was initiated based on an application filed by Deepak Nitrite Limited, supported by other Indian producers.

·         The investigation covers imports during a specified period, with injury assessment based on data from 2022-2025.

Product Description and Classification

·         Sodium Nitrite (SNI) is an industrial chemical in solid or liquid form, characterized by its crystalline appearance.

·         It is highly soluble in water, hygroscopic, and classified under Customs Tariff sub-heading 28341010.

·         The product is considered like article to domestically produced goods, with no significant differences.

Domestic Industry and Stakeholders

·         The domestic industry includes Indian producers like Deepak Nitrite Limited, supported by others such as Kutch Chemical Industries.

·         Rashtriya Chemicals & Fertilizers Limited has ceased production of SNI due to import competition.

·         The applicant certifies no relation to exporters or importers from China PR.

Alleged Dumping and Methodology

·         The applicant claims China PR should be treated as a non-market economy, affecting normal value determination.

·         Normal value was estimated based on import prices from the European Union and domestic sales, with adjustments.

·         Export prices were calculated from CIF data, adjusted for freight, insurance, and handling costs.

·         The prima facie evidence indicates significant dumping margins from Chinese exporters.

Injury and Causal Link

·         Evidence suggests increased import volume, price undercutting, and adverse effects on domestic industry profitability.

·         Domestic producers have experienced losses, reduced sales, and deteriorated performance due to dumped imports.

·         The investigation aims to establish a causal link between dumped imports and injury to domestic industry.

Investigation Procedure and Stakeholder Submissions

·         Interested parties must register on the SETU portal and submit relevant data within specified deadlines.

·         Confidential submissions require non-confidential summaries, with strict guidelines on marking and timing.

·         The authority will examine confidentiality claims and may reject incomplete or improperly marked submissions.

Timeline and Further Actions

·         Parties are advised to file responses and comments within 37 days of the initiation notification.

·         Extensions of up to 15 days may be granted for modifications in methodology.

·         Non-cooperation by stakeholders may lead to findings based on facts available, affecting the investigation outcome.
