DGTR Initiates Sunset Review of Anti-Dumping Duty on Natural Mica Pearl Industrial Pigments from China on Sudarshan Chemical Industries Complaint

Ø  Anti-dumping Duty on Natural Mica-Based Pearl Industrial Pigments excluding Cosmetic Grade from China Revised in Midterm Review by Customs Notification No. 47/2021 -Customs (ADD) dated 26th August 2021 - Notification Set to Expire on 25 August 2026

·         Initiation of Review: The Directorate General of Trade Remedies (DGTR) has initiated a sunset review investigation on anti-dumping duties imposed on imports of Natural Mica Pearl Industrial Pigments (excluding cosmetic grade) from China PR.

·         Applicant: The application requesting the review was filed by Sudarshan Chemical Industries Limited, representing the domestic industry.

·         Legal Basis: The review is initiated under the Customs Tariff Act, 1975 and the Anti-Dumping Rules, 1995, which govern anti-dumping investigations in India.

·         Reason for Sunset Review: Anti-dumping duties normally expire after five years, unless a review finds that removing the duty would likely lead to continuation or recurrence of dumping and injury to domestic industry.

·         Product Under Consideration: The investigation covers Natural Mica Pearl Industrial Pigments used for industrial applications, excluding pigments meant for cosmetic use.

·         Objective of the Investigation: The Authority will determine whether ending the existing anti-dumping duty could result in renewed dumping by Chinese exporters and harm to Indian producers.

·         Next Step: DGTR will collect information from exporters, importers, and other stakeholders before deciding whether the anti-dumping duty should continue.
