·         Product: Polyvinyl Chloride (PVC) Suspension Resins (S-PVC)

·         Origin/Export from: China PR, Indonesia, Japan, Korea RP, Taiwan, Thailand, USA

·         Scope: Suspension grade PVC resins with K-value above 55 and up to 77.

·         Exclusions: Ultra-low (<55) and ultra-high (>77) K-value PVC, CPVC, cross-linked PVC, paste/emulsion resins, mass polymerization PVC, and blending resins.

Background

·         Petition filed by Chemplast Cuddalore Pvt. Ltd., DCM Shriram Ltd., and DCW Ltd.

·         Investigation initiated on 26 March 2024 after prima facie evidence of dumping.

·         Preliminary findings (30 Oct 2024): confirmed dumping at below normal value, injury to domestic industry, and recommended provisional anti-dumping duty.

·         Multiple hearings, submissions, and disclosure statements followed.

·         Gujarat High Court initially ordered exclusion of certain specialty grades, but Supreme Court stayed that order in May 2025.

o    Found no conclusive evidence of distinct specialty grades; lab reports show Indian and imported grades are comparable.

o    Confirmed DCW Ltd. and others used their own S-PVC to manufacture CPVC.

o    Noted that off-grade PVC cannot be excluded.

o    Reaffirmed that S-PVC across K-57 to K-75.5 is produced domestically, hence no need for grade-wise exclusions.

·         Injury analysis period: 2020–21 to 2022–23 and POI

Key Findings

1.    Imports from subject countries were at dumped prices, causing material injury to Indian producers.

·         Duties to be levied up to Non-Injurious Price (NIP) calculated from verified cost data.
