Guidance on Implementation of Executive Order 14324 – Suspension of Duty-Free De Minimis Treatment

·         Additional Parties Qualified for the Payment of Duty on International Mail Shipments Pursuant to Executive Order 14324 “Suspending Duty-Free De Minimis Treatment for All Countries”

Background
Pursuant to Executive Order (EO) 14324,
“Suspending Duty-Free De Minimis Treatment for All Countries”, issued on July 30, 2025, the duty-free de minimis exemption under 19 U.S.C. § 1321(a)(2)(C) will no longer apply to shipments entering the United States (other than those covered by 50 U.S.C. § 1702(b)).

Effective Date: August 29, 2025
Scope: Applies to all shipments, including those entering through international mail.

Collection of Duty

·         Under the EO, duty on international mail shipments must be collected and paid by:

1.    The international mail carrier, or

2.    A qualified third party acting on behalf of the carrier.

·         U.S. Customs and Border Protection (CBP) has certified specific parties as “qualified” to collect and remit duties in accordance with procedures outlined in CSMS #65934463.

·         The list of certified parties is available and regularly updated on the CBP website:

Becoming a Qualified Party
Any entity wishing to be certified as a qualified party must:

1.    Submit a CBP Form 5106 (Importer ID Input Record) to CBP,

2.    Obtain and maintain a valid customs bond,

3.    Fulfill other requirements set out in CBP guidance.

·         Entities that already have an active CBP Form 5106 and a valid bond, and wish to be considered for qualification, should email CBPDM@cbp.dhs.gov.

·         Only those parties formally listed by CBP via CSMS messages or on the CBP website will be recognized as “qualified” under EO 14324.

Pursuant to Executive Order 14324 of July 30, 2025, (“Suspending Duty-Free De Minimis Treatment for All Countries”), effective August 29, 2025, de minimis duty-free treatment under 19 U.S.C. § 1321(a)(2)(C) will no longer be available for shipments entering into the United States not covered by 50 U.S.C. § 1702(b), including those entering through international mail. 

As outlined in the Executive Order, duty on international mail shipments must be paid by the international mail carrier or a qualified party acting in lieu of the carrier.  CBP has certified the following parties as qualified to collect and pay duty on international mail, using the process outlined in CSMS #65934463.

CBP will be posting the list of qualified parties to the CBP website and updating it as additional parties are certified at: https://www.cbp.gov/trade/basic-import-export/e-commerce

Any party wishing to be certified as a qualified party should follow the process outlined in this guidance which includes submitting a CBP Form 5106 to CBP, obtaining a bond, and other requirements.  If a party already has a CBP Form 5106 on file and an active bond, and wishes to be qualified, please email CBP at CBPDM@cbp.dhs.gov.  Only parties listed via CSMS message or on CBP.gov are considered qualified third parties under Executive Order 14324.
