Dry Whey (Mattha) in HS Codes 0404 10 20 and 0404 10 90 Duty Raised to 40%

·         Liquid Whey in Tariff Items 040410 10 and 0404 90 Continues at 30%

Seeks to increase tariff rate of basic customs duty (BCD) on tariff items covered under tariff sub head 0404 10 i.e. Whey and modified Whey, whether or not concentrated or containing added sugar or other sweetening matter, and under tariff item 0404 90 00 i.e. Other Whey from present 30% to 40% by invoking section 8A (1) of the Customs Tariff Act, 1975

Whereas the Central Government on being satisfied that the import duty leviable on goods falling under heading 0404 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), should be increased and that circumstances exist which render it necessary to take immediate action.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 8A of  the  said  Customs  Tariff  Act,  the  Central  Government,  hereby  directs  that  the  First Schedule to the said Customs Tariff Act, shall be amended in the following manner, namely:-

In the First Schedule to the said Customs Tariff Act, in Section I, in Chapter 4, against tariff items 0404 10 10, 0404 10 20, 0404 10 90 and  0404 90 00, for the entries in column (4), the entries "40%" shall be substituted.

[Notification No. 44/2018 – Customs dated 10 April 2018]

Seeks to amend notification No. 50/2017 Customs dated 30.06.2017 so as to maintain effective rate of BCD on Whey, concentrated, evaporated or condensed, liquid or semi-solid (0404 10 10) and Other Whey (0404 90 00) at 30%.

In exercise of the powers conferred by sub-section (1) of section 25 of  the Customs Act, 1962 (52 of 1962) and sub-section (12) of section 3 of the Customs Tariff Act, 1975 (51 of 1975), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India, Ministry of Finance (Department of Revenue), No. 50/2017-Customs, dated the 30th June, 2017, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide, number G.S.R. 785(E), dated the 30th June, 2017, namely:-

In the said notification, in the Table, after serial number 7 and the entries relating thereto, the following serial numbers and entries shall be inserted, namely:-
