Senate Democrats Demand Tariff Refunds for Consumers

A group of Senate Democrats is asking US Trade Representative Jamieson Greer whether the Administration intends to provide refunds to consumers for the President’s latest round of tariffs if they are found illegal by the courts.

“Without such a plan, President Trump’s reckless trade policy risks becoming nothing but a multi-billion-dollar scheme to transfer wealth from consumers to giant corporations,” the senators wrote in a letter led by Sen. Elizabeth Warren (D-Mass).

Also signing the letter are Sens. Martin Heinrich (D-NM), Sheldon Whitehouse (D-RI), Richard Blumenthal (D-Conn), Bernie Sanders (I-Vt) and Cory Booker (D-NJ).

The senators specifically asked about refunding consumers who paid higher prices because of the tariffs. They noted that after the US Supreme Court ruled the President’s International Emergency Economic Powers Act tariffs illegal, the Administration began a process to allow tariff refunds to companies, but similar refunds were not offered to consumers. In the IEEPA decision, the court only addressed refunds to businesses and not consumers.

“The net result of this chaos and incompetence has been a broken IEEPA refund system in which corporations recover billions of dollars while the consumers who paid thousands of dollars in higher prices receive nothing,” the senators wrote.

The President put new tariffs in place to replace the revenues lost by ending the IEEPA tariffs.

Those tariffs are currently being challenged in US courts. If they also are found to be illegal, the senators said the Administration should have a plan to ensure consumers are refunded as well as businesses.

“Despite the legal doubt surrounding the fate of these new tariffs, the Administration has refused to provide a plan as to how it would get refunds back to the American people in the event they are struck down,” they wrote. “This means that consumers could once again be left with nothing as giant corporations pocket tariff refunds.”

The senators asked the USTR to provide answers about the IEEPA tariff refunds and on the three new replacement tariffs by October 5.
